• 1) Modal boleh ambil semula atau tidak?
Jawapnya: Modal boleh diambil semula, ini kerana sesebuah aqad transaksi Riba tidak diiktiraf dalam Islam. Justeru bermakna, modal yang telah diletakkan juga tidak hangus malah sipelabur layak mendapatkannya semula. Adapun jika, kontrak tidak boleh dibatalakan di pertengahan jalan. Harus hukumnya untuk menunggu bagi mendapatkan semula modalnya. Tidak kurang mahupun lebih.
• 2) Apa nak buat dengan keuntungan yang telah diperolehi?
Para ulama dari empat mazhab telah bersepakat berkenaan kewajiban melupuskan harta haram dengan mendermakannya.
Syeikh Atiyyah Saqar (Bekas Ketua Lajnah Fatwa Al-Azhar) berkata:: Wajib melupskan harta yang haram ketika bertawbat, ia boleh dilakukan dengan memulangkan kembali harta itu kepada tuannya (jika diketahui) atau kepada warisnya, dan jika tidak mampu diketahui , hendaklah diserahkan kepada faqir miskin bagi memisahkan diri darinya dan bukannya bagi meraih pahala (dari serahan itu). (Min Ahsanil Kalam Fil Fatawa, hlm 2/65)
Hujjah utama para ulama dalam hal mendermakan wang haram seperti ini adalah pelbagai hadith Rasulullah SAW yang diriwayat Abu Daud dengan sanad yang baik, hadith tentang kekalahan Rom tadi, em frente a Ibn Mas & # 8217; ud yang diriwayatkan oleh Al-Bayhaqi 6/188 dan banyak lagi.
• 3) Jika Nak Derma ke mana Yang Boleh?
Rinngkasannya mudah sahaja: -
a - Faqir miskin samada dari kalangan ahli keluarga atau tidak. Majoriti mazhab Islam termasuk ulama silam memberikan fatwa harus untuk indivíduo yang benar-benar dalam keadaan ini menggunakannya untuk dirinya atas sebab miskin dan faqir. Ketika itu, harta yang kotor itu, tidak lagi menjadi kotor. Tetapi mestilah dengan syarat ianya disertai dengan perasaan insaf dan bertawbat dari perbuatan haramnya. (Al-Ikhtiyar li Ta & # 8217; lil al-Mukhtar, 3/61; Al-Qawaid, Ibn Rejab, hlm 129; Ihya Ulumiddin, 2/145; Al-Majmu & # 8217; 9/428)
SIAPA ITU FAQIR DAN MISKIN?
Menurut majoriti mazhab dan ulama, Faqir itu adalah Mereka yang tiada memilki harta (duit ataupun harta seperti kereta, rumah) dan tiada pula kemampuannya dan kelayakan bagi mencari harta halal yang mampu mencukupi tinha keperlaun asasnya dari sudut makan, pakaian dan tempat tinggal bagi dirinya dan yang di bawah tanggungannya. Seperti ia perlukan minima RM 10 untuk keperluan asas, tetapi hanya perolehi RM 1, 2 atau 4 sahaja.
MIskin pula, ia memerlukan RM 10, tetapi hanya memiliki RM 7 atau 8 sahaja. Selain itu, termasuk juga mereka yang mempunyai harta tetapi tidak dapat digunakan kerana sebab-sebab tertentu seperti jauh dan sebagainya. Termasuk juga dalam takrif ini seperti para pelajar univeristi yang wangnya hanya mencukupi untuk makan dan manukupi untuk membeli peralatan asasinya seperti buku, kitab, tatkala itu ia juga dikira miskin (Nihayatul Muhtaj, Ar-Ramli, 6/151, hlm 153)
Tetapi awas, jangan ada yang menggunakan pelbagai helah untuk menganggap diri miskin semata-mata untuk menggunakan harat haram ini untuk dirinya. Allah SWT maha mengetahui akan segala helah makhluknya.
• b - Badan Kebajikan Awam & amp; pembinaan Kemudahan Awam Yang Halal.
Saya kira ini tidak lagi memerlukan huraian kerana kejelasannya.
• c - Masjid & amp; Surau.
Pada asalnya ia tidak berapa digalakkan, tetapi bolehlah mengambil pandangan yang lebih ringan dalam hal ini iaitu ia merupakan pandangan Ulama Hanafi, Mazhab Syafie yang berfatwa harus menggunakan duit haram yang tidak diketahui pemilik ini untuk membina masjid dan surau. (Al-Majmu & # 8217; 9/428; Hasiyah Radd Al-Muhtar, 2/92);
• 4) Tak mampu nak derma seluruh keuntungan Riba itu sekali gus, adakah jalan lain?
Bagi yang benar-benar insaf, dan wang keuntungan masih ada, tetapi jika didermakan maka habis seluruh wang simpanan atau membawa kesukaran belanja keluarga yang teruk. Ketika itu bolehlah di dermakan wang keuntungan tersebut secara berperingkat khas bagi mereka yang berada dalam situasi ini. Ia samalah dengan dalil berkenaan tindakan khalifah Umar Ab Aziz tadi.
• 5) Dah guna habis duit beli itu ini, memang tak mampu nak ganti balik.
Untuk kumpulan sebegini, yang terpenting adalah bertawbat dan memutuskan semua keterlibatan dengan wang haram ini lagi. Dalam masa yang sama memperbanyakkan sedeqah sedikit demi sedikit sepanjang hidupnya. Ianya perlu bagi menghapuskan dosa-dosa silam yang melekat di hati, kehidupan dan dagingnya. Ia berdasarkan sabda Nabi SAW: -
اتق الله حيثما كنت وأتبع السيئة الحسنة تمحها وخالق الناس بخلق حسن.
Ertinya: Bertaqwalah kamu kepada Allah di mana sahaja kamu berada dan ikutilah perbuatan dosamu dengan pahala, nescaya ia akan dapat memadamnya dan menjadikan kamu dengan ahklah yang mulia & # 8221; (Riwayat At-Tirmidzi, no 1910, At-Tirmidiz: Hadith Hasan)
Disebut di syarahnya akan erti penghapusan itu: -
والمراد يمحو الله بها آثارها من القلب أو من ديوان الحفظة, وذلك لأن المرض يعالج بضده فالحسنات يذهبن السيئات.
Ertinya: apa yang dimaksudkan adalah Allah akan menghilangkan kesan dosa itu dari hati, kerana kesan dosa penyakit itu dirawati dengan apa yang bertentangan dengannya, maka kebaikan menghialngkan segala kejahatan. (Tuhfatul Ahwazi, Hadith não 1910)
• 6) Bolehkah guna duit untung itu untuk buat modal perniagaan halal?
Ini juga satu persoalan yang kerap ditanya, bagi saya ia hanya akan menjadi harus sekiranya anda benar-benar dalam keadaan bermasalah sekiranya melupuskan terus wang-wang haram itu. Hanya Allah yang dapat mengetahui samada seseorang itu benar-benar sudah sampai tahap untuk mengambil pandangan yang lebih ringan iaitu, harus menggunakannya sebagai modal untuk yang halal dengan azam dan niat ikhlas untuk mendermakan modal dari yang haram itu.
Ulama silam juga pernah membincangkan berkenaan hukum menggunakan keuntungan yang didapati dari perniagaan halal, bagaimanapun modalnya adalah wang curi atau haram. Dalam hal ini, Imam Malik, Imam As-Shafie, Imam Abu Yusof Dan Sheikh Zufar Huzayl bersetuju bahawa pencuri tersebut Berhak Mendapat Bahagian Keuntungan Daripada Pelaburannya Walaupun Modal Asalnya Adalah Haram, Tetapi i Wajib Memulangkan Kembali wang yang dicuri (wang yang digunakan sebagai modal perniagaannya atau pelaburannya) kepada yang berhak. (Bidayatul Mujtahid, Ibn Rusyd, 2/241; Rawdah at-Tolibin, An-Nawawi, 4/211; Al-Hawi, al-Mawardi, 7/337).
Berdasarkan ijtihad ini, kita berpandangan bahawa pelabur yang terdesak dan sukar untuk mendermakan sekaligus wang untungnya adalah melaburkannya ke tempat halal dan harus mengambil keuntungan daripada perniagaan / pelaburan yang dijalankan walaupun pada modal yang digunakan untuk tujuan tersebut terdapat bahagian yang haram. TETAPI PERLU DIINGAT ia hanya harus dilakukan di ketika: & # 8211;
a-Telah bertawbat dari kesilapan serta menghadapi masalah untuk mendermakan secara keseluruhannya pada satu masa.
b - Di ketika insaf dan berniat ingin & # 8216; converter & # 8217; atau mengubah semuanya kepada yang halal serta tiada modal lain.
c - Tidak lagi meneruskan aktiviti haram itu sama sekali.
Kesimpulan cara yang perlu dilakukan; ringkasnya cara umumnya adalah seperti berikut: -
Pertama: Cara terbaik adalah bertawbat. Kerana terjebak tanpa ilmu dalam saham-saham yang berunsur Riba secara sepakat ulama yang berkelayakan ini.
Kedua: Perlu diingat beberapa dalil seperti sabda Nabi SAW: ertinya & # 8221; Sesungguhnya Allah itu baik dan tidak menerima kecuali sesuatu yang baik .. & # 8221; (Riwayat Muslim, 3/85).
Ketiga: Harta haram tidak sesekali boleh digunakan untuk manfaat diri pemiliknya, samada untuk kegunaan pembayaran cukainya, saman keretanya, makanan keluarganya, tambang basnya dan lain-lain untuk kepentingan dirinya. Apatah lagi digunakan untuk menunaikan Haji dan Umrah. Kemungkinan Haji itu dilihat sah berdasarkan rukun dan syaratnya tetapi tidak diterima Allah SWT kerana ia adalah dari hasil yang tidak baik sama sekali.
Sebuah hadith lain pula menyebut; Ertinya: & # 8220; Barangsiapa yang mengumpulkan harta yang haram kemudian mendermakannya, tiadalah baginya sebarang pahala (kerana harta itu bukan hartanya) dan penanggungan dosanya kekal (sehingga bertawbat) & # 8221; (Riwayat al-Hakim, sohih menurut al-hakim dan disepakati oz-Zahabi; Albani: Ianya lemah)
Berdasarkan sebuah hadith pula.

Berdasarkan hadith ini, terdapat beberapa pihak yang keliru lalu menyangka ianya boleh digunakan untuk manfaat diri selain makan dan minum. Ini kesilapan dalam memahami konsep harta haram.
